Common questions
- Is my apartment smaller than the lease says?
Often, yes. Listed floor areas are frequently copied from old plans or estimated. Balconies, sloped ceilings and cellar rooms are commonly overcounted. An independent measurement to the Wohnflächenverordnung (WoFlV) gives you the real figure.
- Can a smaller apartment mean money back on my Betriebskosten?
Operating costs (Betriebskosten) that are split by floor area should be allocated on the actual area, not the figure in the lease. If your flat is smaller than stated, your share may be too high. We measure and document the real area; your Mieterverein or lawyer handles the claim.
- What if the difference is more than 10 percent?
German case law treats a shortfall of more than 10 percent against the contractual area as a defect that can justify a rent reduction. A signed measurement report is the evidence you need to raise it.
